What Changed

Before the settlement:

  • Sellers were required to offer a buyer's agent commission through the MLS
  • The typical total commission: 5–6% (split between listing and buyer's agents)
  • Sellers had little ability to opt out

After the settlement:

  • Sellers are no longer required to offer any buyer's agent commission in MLS listings
  • Buyers must now sign a written Buyer Representation Agreement before touring
