NAR Settlement 2024: What It Means for Home Sellers

What Changed

Before the settlement:

• Sellers were required to offer a buyer's agent commission through the MLS
• The typical total commission: 5–6% (split between listing and buyer's agents)
• Sellers had little ability to opt out

After the settlement:

• Sellers are no longer required to offer any buyer's agent commission in MLS listings
• Buyers must now sign a written Buyer Representation Agreement before touring
• Buyers and their agents negotiate compensation directly
• Sellers can choose to offer $0, 1%, 2%, or whatever they want to buyer's agents

What This Means for You

1. You can offer zero buyer's agent commission. Many buyers — especially in competitive markets — will make offers regardless. Cash buyers, relocating buyers, and buyers who find your home directly don't need an agent.
